Sexual Harassment Policies

 

A Code of Ethics on Sexual Harassment:

Guidelines of the North FC

Sexual harassment is defined by the EEOC as “Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance, or creates an intimidating, hostile, or offensive work environment.”

NFC prohibits any type of discrimination under title VII of the Civil Rights Act including sexual harassment which falls under title VII and states “It shall be an unlawful employment practice for an employer … to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin.”  Below are NFC, . guidelines regarding sexual harassment:

A. In the above context, the term "sexual harassment" may be used to describe a wide range of behaviors. It includes, but is not limited to, the following: generalized sexist remarks or behaviors, whether on or off of the field; requests for sexual favors; sexual advances, whether sanction free, linked to reward, or accompanied by threat of retaliation; the use of authority to emphasize the sexuality or sexual identity of a player in a manner which prevents or impairs that player's full enjoyment of sporting benefits, and sexual assaults. Such behaviors are unacceptable because they are forms of unprofessional conduct which seriously undermine the atmosphere of trust essential to the all at NFC,.

B. The potential for sexual harassment is not limited to incidents involving NFC, . staff but to all players and parents.

C. Further, any unprofessional behavior which condones sexual harassment or disregard complaints of sexual harassment from staff, players and parents is not allowed and encourages an environment of sexual harassment to exist and seriously undermine the atmosphere of trust essential to NFC, .

II. In addition to sexual harassment, amorous relationships that might be appropriate in other circumstances are inappropriate and should be avoided including relations between staff members of NFC, . and between staff members and any player for whom he or she has a professional responsibility too. It is implicit in the idea that the use of professionalism is the recognition by those in positions of authority and that in their relationships with players there is always an element of power. It is incumbent upon members of the NFC, . staff not to abuse, nor seem to abuse, the power with which they are entrusted, since relationships between staff of the NFC, . and players are always fundamentally in nature.

III. Any NFC, . staff who violates willing or unwilling any person’s rights according to Title VII of the Civil Rights act including sexual harassment or any of the guidelines set forth, will be suspended, without pay, and from all duties associated with NFC, .  The suspension will hold until a meeting can be held with the board of directors.  Such meeting must be held within 15 days of the reporting of the incident and legal counselors are permitted.
